SynopsisSA3265 required local authorities have a policy that requires juveniles who have been found unlawfully in possession of a firearm in a school be held for not less than 24 hours. AnalysisSA3265 removed local control of local policies. By making a blanket requirement, the local authorities also loose ability to evaluate specific circumstances. Specifically, what if the gun was left in the car by a parent, unbeknownst to the juvenile? Local situations and local customs require local determination of policy as long as the policies do not violate the Constitution.
