February 2, 2007 - Referred to the Subcommittee on Crime, Terrorism, and Homeland Security.

Synopsis

The bill spends more federal dollars in the form of:
  1. requiring federal agencies to feed pertinent information into the NICS system, 
  2. grants to state and local governments for the purpose of feeding more lists into the NICS system,
  3. requires the DOJ to provide reports to Congress.

Analysis

Any bill introduced by McCarthy is seen with extreme skeptisism. She is a rabid antigun rights legislator. Except for some wording in the Findings and a few dates, this bill is identical to House Bill 1415, the NICS Improvement Act of 2005.

In very general terms, supporting the law of the land demands that you support the enforcement of the prohibited persons definitions. On the other hand, it is impossible to support bills like the Lautenberg Amendment which see to expand the types of prohibited persons.

Although this bill seeks to define the NICS system as an all-encompassing prohibited persons list, Ms. McCarthy failed to support House Bill 1384, of the 109th Congress. The Firearm Commerce Modernization Act., H.R.1384, permitted nationwide purchase of firearms and could have been a benefit of having an all-encompassing prohibitted persons list.

By the end of the 109th session, H.R.1415 had only 35 cosponsors out of 435 representatives. We will have to see if the change in House leadership changes the fate of this bill.
