SynopsisThe main text is short, so here it is:
(a) In General- Except as provided in section 930 of title 18, United States Code, the Secretary of the Interior shall not promulgate or enforce any regulation that prohibits an individual from possessing, transporting, or carrying a firearm (including an assembled or functional firearm) in any unit of the National Park System or the National Wildlife Refuge System if-- (1) the individual is not otherwise prohibited by law from possessing, transporting, or carrying the firearm; and (2) the possession, transportation, or carrying of the firearm is in compliance with the law governing possession, transportation, or carrying of firearms in parks of the State in which the unit of the National Park System or the National Wildlife Refuge System is located. (b) Rule of Construction- Nothing in this Act shall be construed to authorize-- (1) the taking of wildlife or fish, except as authorized by the Secretary; or (2) the discharge of firearms without legal justification or excuse, except as authorized by the Secretary. AnalysisIn the late 80s, a friend went backpacking in Denali National Park. He was given grief for not carrying a firearm. When I did the same thing in the late 90s, I was told that I could not take a firearm. Of course, the threat had not changed. Crimes happen everywhere. Ridding the law of another 'gun free zone' is great. This law is better than an amendment to a budget, as it must be passed every year. Pass this law and we will be done.
