The Congressional Record shows 3 amendments being proposed and 22 more submitted to S.397 as of last night. The key here is that proposed amendments will be heard on the floor and the submitted ones may never reach the floor for consideration.
The 3 proposed amendments are as follows:
- SA1605 - Craig - To amend the exceptions.
- SA1606 - Frist - To make clear that the bill does not apply to actions commenced by the Attorney General to enforce the Gun Control Act and National Firearms Act.
- SA1626 - Kohl - To amend chapter 44 of title 18, United States Code, to require the provision of a child safety lock in connection with the transfer of a handgun.
Research will take time, but look for details later today.
Senate Amendment 1623 seems to have moved from submitted to proposed. It writes in a 'gross negligence' exemption to S.397. Unfortunately it runs the risk of gutting S.397 because a court case would be required to determine gross negligence.
9:30PM ET - S.397 is done for the night. There is an agreement to have a short debate and a vote on each of a series of amendments tomorrow and go directly to an up/down vote on S.397. Some of them are as follows:
- SA1642 - Reed - a complete substitute for the bill which would serve to gut the bill.
- SA1615 - Kennedy - another armor piercing ammo bill. See SA2619 for last year's.
- SA1619 - Corzine - an exemption for police relative to S.397. See SA2629 for last year's.
- SA1620 - Lautenberg - an exemption for children relative to S.397. See SA2633 for last year's.
There are a few other amendments to be provided by Republicans, but these are the ones to be presented by opponents of S.397. Take note that every one of these bills had an analogous bill last year and not one of them passed last year. Also take note that there is not a bill that addresses .50 caliber firearms.
Ten more amendments were offered to S.397 today. That is in addition to the 25 that were offered yesterday. It will take a few days to get availability of all the necessary information published by the Congressional Record. In the grand scheme, the threat to the viability to S.397 is very small at this point.
At this point, tomorrow is expected to be the last day that S.397 will need to be on the calendar.
