26 USC 4181 imposed an excise tax on each firearm manufactured or imported into the US. Section 1131 of H.R.3 ended that tax, which was passed onto the consumer, for manufacturers and gunsmiths that produce fewer than 50 firearms per year. This change is tough to find as it is buried in the 'Highway Reauthorization and Excise Tax Simplification Act of 2005'. It was passed July 29 and goes into effect after September 30. Next Tuesday, September 6th, Congress will be starting the second session of the 109th Congress. There are many bills we like and many we don't. But, the next gun control measure to be dealt with will be the Protection of Lawful Commerce in Arms Act in the House. It appears that the petition pointed to by Triggerfinger may be old enough to be a waste of time. But the issue does bring up some questions:
- Is it time to try to remove the Hughes Amendment from FOPA 86?
- If not the whole Hughes Amendment, can we get a bill passed to disable a part of the Hughes Amendment so that pre-May 1986 full-auto weapons could, once again, be registered? This would allow LEO and military surplus firearms go into the civilian supply.
- Could we get a bill passed forcing all military rifles, shotguns and side arms to be disposed of by the CMP?
