SynopsisThe effect of this law is as follows:
- Section 2 (a)
- Reinstates the definition of “large capacity ammunition feeding device” as defined by the 1994 AWB.
- Reinstates the prohibitions from possession or transfer of post-ban large cap mags.
- Requires identification of the 'new' post-ban magazines.
- Section 2 (b) Reinstates the prohibitions from possession or transfer of post-ban large cap mags.

AnalysisThis bill is unenforceable as written. The first section of law that it reinstates is the definition of “large capacity ammunition feeding device”. In this definition is the requirement that the magazine be manufactured after the enactment date of the 1994 AWB (September 13, 1994). It would criminalize possession of large cap mags that have been legally manufactured and possessed since the expiration of the 1994 AWB (September 13, 2004). These post-ban mags are unmarked and unidentifiable from pre-ban mags.
It makes no prohibitions specifically to "semiautomatic assault weapon" but prohibits transfer of large cap mags with them. Of course, it would already be illegal to transfer or possess these same mags, so this seems a bit redundant, even for the gun grabbing crowd. But it does reintroduced the concept of the SAW back into the law for later use.
The bottom line is that McCarthy is a long time gun grabber and this is just one of her many bills. None have been respectful of the Constitution.
