The National Shooting Sports Foundation has issued this statement:

NSSF ASKS WHY MAYOR REBUFFED ANTI-STRAW PURCHASING PROGRAM . . . Following today’s announcement by New York City Mayor Michael Bloomberg of a federal lawsuit against a group of out-of-state firearms dealers for alleged improper sales to private investigators, the National Shooting Sports Foundation renewed the firearm industry’s longstanding commitment to cooperating with law enforcement in their efforts to aggressively enforce our nation’s firearms laws but questioned the appropriateness of the mayor’s actions and his refusal to work with the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and NSSF in their anti-straw purchasing crime prevention and public awareness program called Don’t Lie for the Other Guy.

Georgia gun store owners deny they sold weapons illegally

New York Public Radio published this shorty: New York Sues Out-of-State Gun Dealers. Corporation counsel Michael Cardozo says , "Particularly when you couple it with the data from the ATF showing that these particular dealers have been engaged for a very long time in just this kind of practice.". But according to the BATFE, the data they are using shows nothing about the dealers. If the suit relies on BATFE data, the defense will have lots of ammunition to shoot it down.

Maybe theyre trying to get around the "beyond a reasonable doubt" burden by bringing a civil trial because they know that playing by the rules wouldnt have netted them any catches. Probably because gun dealers, when someone presents them with an obvious opportunity to break the law usually thinks "ATF sting!"  
 
The ATF, as maligned as it deservedly is, probably has some sort of non-entrapping, court-tested procedure for catching dealers who facilitate straw purchases. The NY guys probably just wanted fodder for a civil trial.  
 
All guessing.
